As the provider of the content, Resentra GmbH is responsible, in accordance with the general legal situation, for its own content which it provides for use. In this context, one should, however, make a distinction between the company's own content and content from other providers, which is accessed by means of links. In this way, Resentra presents “outside content”, but is only responsible for this content if it is known that this content is contrary to the law and punishable and it is technically possible or reasonable to prevent the use of this content, § 5 paragraph 2 TDG.
Resentra GmbH has checked the outside content at the time it was first linked, to ascertain whether it would cause a liability to arise under civil and/ or criminal law. According to the TDG, because such “links” are, however, dynamic, “live” links, the provider of the content – Resentra – is not legally obliged to constantly check the contents of the links for changes which would newly establish a liability. Only when it is ascertained or being pointed out by others that a new, concrete responsibility according to civil and/ or criminal law has arisen can and will the offering of the content be ceased, if this is technically possible and reasonably to be expected. The above-mentioned possibility and reasonableness are not influenced if the unlawful and legally punishable content is also accessed from other servers after the ceasing of access by Resentra GmbH.
